1. Geltungsbereich und Vertragspartner Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge über die mietweise Überlassung von Wohnmobilstellplätzen, die zwischen der MO-Tronic GmbH, Wohnmobilhafen Elbepark Bunthaus, Moorwerder Hauptdeich 33, 21109 Hamburg (nachfolgend „Betreiber“ oder „wir“) und den Gästen (nachfolgend „Gast“ oder „ihr“) geschlossen werden. Abweichende AGB des Gastes werden nicht anerkannt.

2. Zulässige Fahrzeuge und Personen Unsere Stellplätze sind ausschließlich für Wohnmobile sowie PKWs mit Dachzelten zugelassen. Wohnwagen, Zelte sowie Übernachtungen von Monteuren sind auf dem Gelände nicht gestattet. Je Wohnmobilstellplatz ist maximal ein Wohnmobil mit höchstens 6 Personen zugelassen. Wir behalten uns das Recht vor, Platz- oder Objektzuteilungen zu ändern, sofern dies aus betrieblichen Gründen zwingend notwendig ist.

3. Buchung und Vertragsschluss Für die vertraglichen Leistungen gelten ausschließlich die Beschreibungen und Preisangaben, die zum Zeitpunkt der Buchung gültig sind. Der Beherbergungsvertrag tritt erst mit dem Zugang unserer schriftlichen Buchungsbestätigung (per E-Mail) in Kraft. Nebenabreden bedürfen der schriftlichen Bestätigung. Bitte prüft die Buchungsbestätigung umgehend auf ihre Richtigkeit.

4. Bezahlung Die fällige Zahlung des Stellplatzpreises ist unmittelbar nach der Buchung über den von uns bereitgestellten Zahlungslink (z.B. PayPal, Kreditkarte) zu begleichen. Geht keine fristgerechte Zahlung ein, wird die Buchung automatisch storniert. Etwaiges Restguthaben aus der Nutzung der Versorgungsstationen kann bei Barzahlung ausschließlich zwischen 9:00 und 10:00 Uhr in der Rezeption ausgezahlt werden, ansonsten erfolgt die Rückerstattung digital.

5. Anreise und Abreise Der gebuchte Wohnmobilstellplatz steht am Anreisetag ab 13:00 Uhr zur Verfügung. Am Abreisetag ist der Stellplatz bis spätestens 12:00 Uhr vollständig zu räumen und zu verlassen. Eine Anreise ist grundsätzlich 24 Stunden am Tag möglich.

6. Umbuchung und Stornierung Ihr könnt eure Buchung bis 10 Tage vor dem Anreisedatum selbst im Kundenkonto oder per E-Mail an info@elbepark-bunthaus.de stornieren. In diesem Fall erheben wir eine Bearbeitungsgebühr in Höhe von 15 % des Buchungspreises. Bei einer späteren Stornierung (weniger als 10 Tage vor Anreise) erstatten wir nur noch 20 % der Gebühren (variable Kosten) sowie das eingezahlte Versorgungsguthaben, da eine kurzfristige Neuvermietung des Stellplatzes nicht garantiert werden kann. Allein die in der Buchungsbestätigung genannten Daten und Fristen sind verbindlich.

7. Platzordnung, Hunde & Verbote Für den gesamten Aufenthalt ist unsere Platzordnung verbindlich, die jederzeit in der Rezeption eingesehen werden kann.

  • Hunde: Hunde sind bei uns herzlich willkommen, jedoch auf dem gesamten Gelände stets an der Leine zu führen. Hinterlassenschaften sind sofort durch den Halter zu entfernen.
  • Cannabis & Drogen: Der Konsum von Cannabis und jeglichen anderen Drogen ist auf dem gesamten Gelände strengstens untersagt. Der Schutz unserer Gäste, insbesondere von Kindern, hat höchste Priorität. Bei schweren Verstößen gegen diese Regeln oder die Platzordnung behält sich der Betreiber das Recht vor, jederzeit einen sofortigen Platzverweis auszusprechen.

8. Haftung Wir haften unbeschränkt bei Vorsatz oder grober Fahrlässigkeit sowie bei vorsätzlicher oder fahrlässiger Verletzung des Lebens, des Körpers oder der Gesundheit. Bei der leicht fahrlässigen Verletzung von wesentlichen Vertragspflichten (Kardinalpflichten) ist unsere Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt. Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht. Im Übrigen ist eine Haftung des Betreibers ausgeschlossen.

9. Informationen zur Verbraucherschlichtung Wir sind weder bereit noch verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

10. Schlussbestimmungen Es gilt das Recht der Bundesrepublik Deutschland. Sollte eine Bestimmung dieser AGB unwirksam sein oder werden, so wird die Gültigkeit der AGB im Übrigen hiervon nicht berührt.

1. Scope of Application and Contracting Parties These General Terms and Conditions (GTC) apply to all contracts regarding the rental of motorhome pitches concluded between MO-Tronic GmbH, Wohnmobilhafen Elbepark Bunthaus, Moorwerder Hauptdeich 33, 21109 Hamburg (hereinafter "Operator" or "we") and the guests (hereinafter "Guest" or "you"). Any deviating terms and conditions of the Guest shall not be recognized.

2. Permitted Vehicles and Persons Our pitches are exclusively authorized for motorhomes and cars with roof tents. Caravans, tents, and overnight stays by fitters/contractors are not permitted on the premises. A maximum of one motorhome with no more than 6 persons is permitted per motorhome pitch. We reserve the right to change site or object allocations if this is absolutely necessary for operational reasons.

3. Booking and Conclusion of Contract The descriptions and prices valid at the time of booking apply exclusively to the contractual services. The accommodation contract only becomes effective upon receipt of our written booking confirmation (via e-mail). Ancillary agreements require written confirmation. Please check the booking confirmation immediately for accuracy.

4. Payment The due payment for the pitch must be settled immediately after booking via the payment link provided by us (e.g., PayPal, credit card). If payment is not received on time, the booking will be automatically cancelled. Any remaining balance from the use of the utility stations can only be paid out in cash at the reception between 9:00 AM and 10:00 AM; otherwise, refunds will be processed digitally.

5. Arrival and Departure The booked motorhome pitch is available from 1:00 PM on the day of arrival. On the day of departure, the pitch must be completely vacated and cleared by 12:00 PM at the latest. Arrival is generally possible 24 hours a day.

6. Rebooking and Cancellation You may cancel your booking yourself in your customer account or by e-mail to info@elbepark-bunthaus.de up to 10 days before the arrival date. In this case, we charge a processing fee of 15% of the booking price. In the event of a later cancellation (less than 10 days before arrival), we will only refund 20% of the fees (variable costs) as well as any deposited utility credit, as a short-term re-letting of the pitch cannot be guaranteed. Only the dates and deadlines stated in the booking confirmation are binding.

Site Rules, Dogs & Prohibitions Our site rules are binding for the entire stay and can be viewed at any time at the reception.

  • Dogs: Dogs are very welcome, but must be kept on a leash at all times throughout the premises. Waste must be removed immediately by the owner.
  • Cannabis & Drugs: The consumption of cannabis and any other drugs is strictly prohibited on the entire premises. The protection of our guests, especially children, is our highest priority. In the event of serious violations of these rules or the site regulations, the operator reserves the right to issue an immediate eviction at any time.

8. Liability We are liable without limitation in cases of intent or gross negligence, as well as in cases of intentional or negligent injury to life, body, or health. In the event of slightly negligent breach of essential contractual obligations (cardinal duties), our liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfillment is fundamental to the proper execution of the contract. Otherwise, any liability of the operator is excluded.

9. Information on Consumer Dispute Resolution We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final Provisions The law of the Federal Republic of Germany shall apply. Should any provision of these GTC be or become invalid, the validity of the remaining GTC shall not be affected thereby.
